By accessing and using the services provided by OrbitAnalyst B.V. ("OrbitAnalyst", "we", "our", or "us"), including our website, fitness facilities, personal training, group classes, and wellness programmes, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not access or use our services. These Terms apply to all visitors, users, members, and others who access or use our services.

Services Description

OrbitAnalyst provides fitness and wellness services including but not limited to:

• Access to fitness facilities and equipment
• Personal training sessions
• Group fitness classes
• Nutrition consultation and guidance
• Wellness programmes and coaching
• Related fitness and health services

Membership and Registration

To access certain services, you must register for membership and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

Membership Requirements

• You must be at least 18 years old or have parental consent
• You must complete all required health and safety forms
• You agree to follow all facility rules and guidelines
• Payment of applicable fees is required for continued access

User Conduct and Responsibilities

You agree to use our services responsibly and in accordance with these Terms. Prohibited conduct includes:

• Violating any applicable laws or regulations
• Harassing, intimidating, or discriminating against other members or staff
• Misusing equipment or facilities
• Bringing unauthorised guests or exceeding guest privileges
• Engaging in activities that may endanger yourself or others
• Recording or photographing other members without consent

Health and Safety

Your health and safety are paramount. By using our services, you acknowledge and agree that:

• Physical exercise involves inherent risks
• You are responsible for consulting healthcare providers before beginning any fitness programme
• You will inform us of any health conditions that may affect your participation
• You will follow all safety instructions and guidelines
• You participate in activities at your own risk

Payment and Fees

Payment terms vary depending on the services selected. All fees are due in advance unless otherwise specified. We reserve the right to modify our pricing with appropriate notice to existing members.

Cancellation and Refunds

Cancellation policies vary by service type. Personal training sessions may be cancelled with 24 hours notice. Membership cancellations require written notice. Refund policies will be provided at the time of purchase.

Intellectual Property

All content, materials, and intellectual property related to OrbitAnalyst services, including but not limited to logos, trademarks, text, graphics, software, and training materials, are owned by OrbitAnalyst or our licensors and are protected by intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of our intellectual property without explicit written permission. This includes workout routines, training programmes, and proprietary methodologies developed by OrbitAnalyst.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, OrbitAnalyst shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability to you for all damages, losses, and causes of action shall not exceed the amount you have paid to OrbitAnalyst in the twelve (12) months preceding the claim.

This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory, even if OrbitAnalyst has been advised of the possibility of such damages.

Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. Results from fitness programmes may vary, and we make no guarantees regarding specific outcomes.

Indemnification

You agree to indemnify and hold harmless OrbitAnalyst, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our services, violation of these Terms, or infringement of any rights of another party.

Termination

We may terminate or suspend your access to our services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your membership by providing written notice in accordance with your membership agreement. Upon termination, your right to use our services will cease immediately.

Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through our website or direct communication. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

Severability
